DeSanto Arbitration

Services

Arbitration, mediation and facilitation for commercial and business disputes.

DeSanto Arbitration can manage fully remote arbitration, facilitation and mediation sessions and hearings, scheduled around the parties' calendars, so disputes move without travel costs or long waits for a hearing date.

Private by design. Sessions are not open to the public, there is no public court docket, and filings stay confidential to the extent the parties agree and the applicable rules allow.

Arbitration

Arbitration offers the parties a private, binding or non-binding forum chosen by contract or agreement. DeSanto Arbitration focuses on an organized, efficient process: clear scheduling orders, proportionate exchange of information and a decision grounded in the contract and the record. Hearings are private, and submissions can be kept confidential by agreement or protective order.

Mediation

Mediation gives the parties a confidential setting to explore resolution on their own terms. The mediator does not decide the dispute. The goal is to help the parties understand risk, cost and options so they can make informed business decisions. What is shared in mediation stays confidential as the parties agree and the applicable rules provide.

Facilitation

Facilitation supports negotiations and multi-party discussions that need structure and a neutral voice, such as contract renegotiations, partnership issues or internal decision-making among stakeholders. Discussions are private, with confidentiality terms the participants set at the outset.
